The terms of service really only apply to yahoo, you can't sue under them, so basically yahoo would just disable the hackers account.

However, the act that has been committed may very well be a federal crime, since the hacker has obtained personal information about you and very possibly sensitive financial information. I found the law, and will put a link to the whole thing in the sources, but here is the section you may care about most:

(2) intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains--

(A) information contained in a financial record of a financial institution, or of a card issuer as defined in section 1602(n) of title 15, or contained in a file of a consumer reporting agency on a consumer, as such terms are defined in the Fair Credit Reporting Act (15 U.S.C. 1681 et seq.);

The law also allows individuals to file civil suits for damages under it, so if the hacker truly did damage, you certainly have recourse. A court may also find that he/she violated the statutes regarding interstate commerce.

Good luck.
